Revised verdict of the Cantonal Court in fraud case:

Former head of accounting sentenced again to 5 1⁄2 years imprisonment and to CHF 10 million compensation payment

On May 4, 2005, EMS-CHEMIE AG, a subsidiary of EMS-CHEMIE HOLDING AG domiciled in Domat/Ems (GR), Switzerland, brought criminal charges against the former head of accounting and a former salesman. In its verdict dated September 3, 2010, the Regional Court Imboden (GR) found both guilty of all charges. The Cantonal Court, as court of appeal, confirmed the conviction on August 24, 2011. The sentence for the former salesman of 3 years imprisonment and a compensation payment of CHF 8.2 million to EMS became final and binding on July 16, 2013 after a further appeal was dismissed by the Swiss Federal Court.

In the case of the former head of accounting, the Swiss Federal Court, as appeal court, returned on July 16, 2013 the verdict to the Cantonal Court for revision of the reasons regarding the charges of cheque fraud.

Today, the Cantonal Court (GR) published its new verdict. It confirmed the first verdict and sentenced the former head of accounting again to 51⁄2 years imprisonment and to payment of CHF 10 million compensation to EMS-CHEMIE.
